Welcome to Wingene VIDA. These Terms of Service (“Terms”) govern your access to and use of the Wingene VIDA mobile application (“App”), as well as its web versions and related services provided by Wingene (“we”, “us”, or “developers”).

By downloading, installing, accessing, or using Wingene VIDA from Google Play or any other distribution channel, you (“User”) agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.

1. Purpose and Nature of the Service

Wingene VIDA is a reflective journaling, self-awareness, and personal growth application built upon the four pillars of the VIDA Method:

  • V (Values): Discovering, clarifying, and reaffirming core ethical principles;
  • I (Imperfections): Lucidity in observing mistakes, blind spots, and opportunities for moral growth;
  • D (Decisions): Converting intentions and reflection into disciplined, conscious action;
  • A (Attention): Exercising presence, mindful awareness, and sensory connection with the present moment.

Important Notice — Medical and Psychological Disclaimer

  • Educational and Philosophical Purpose: Wingene VIDA is intended solely as a philosophical, reflective, and personal organization tool.
  • Not a Substitute for Professional Care: The App DOES NOT provide medical diagnosis, psychological counseling, psychiatric treatment, or clinical emergency mental health services.
  • Seeking Qualified Help: If you are experiencing acute emotional distress, depression, suicidal thoughts, or any mental health emergency, please immediately consult a qualified healthcare provider or reach out to local crisis hotlines.

2. Data Sovereignty, Local Storage, and Backups

User privacy and data sovereignty are fundamental design principles of Wingene VIDA:

  • Local Storage (Offline-First): All your notes, journal entries, ratings, tags, and reflections are saved locally on your device. The developers do not operate proprietary servers to store, access, or inspect your private journal entries.
  • Optional Google Drive Sync: The App offers an optional cloud backup feature executed directly between your device and your own personal Google Drive account in a dedicated, hidden application folder (appDataFolder). The developers have no access to your Google account or your files.
  • End-to-End Encryption and User Password: If you choose to configure a Backup Password, your data is encrypted locally using the robust AES standard before being transferred to Google Drive.
    • Important: Your backup password is under your sole responsibility. We do not store, know, or manage this password. If you forget it, we cannot recover or decrypt your backup data.
  • User Responsibility for Data Safety: Users are solely responsible for maintaining the physical security of their devices, setting passwords, and keeping regular backups.

3. Artificial Intelligence Features (Google Gemini API)

Wingene VIDA offers optional AI-assisted reflective insights powered by the Google Gemini API:

  • Suggestive Nature: AI-generated reflections, summaries, and categorization within the VIDA pillars are intended as exploratory prompts to stimulate personal contemplation.
  • No Guarantee of Infallibility: Artificial intelligence language models may occasionally produce subjective, incomplete, or imprecise outputs. The User retains ultimate judgment and authority over their life choices and actions.
  • Privacy Compliance: In accordance with our Privacy Policy, journal entries sent for AI analysis are processed anonymously through enterprise paid-tier APIs, under terms that prohibit Google from using user content to train public AI models.

4. Subscriptions, Payments, and In-App Purchases (Google Play Billing)

Wingene VIDA may offer both free features and optional premium functionality via subscriptions or one-time purchases:

  • Google Play Billing: All financial transactions, billing, invoicing, and subscription renewals are handled exclusively through the Google Play Store, subject to Google Play’s Developer Distribution Agreement and Consumer Terms.
  • Automatic Renewal: Recurring subscriptions automatically renew at the end of each billing cycle unless cancelled by the User at least 24 hours prior to the renewal date.
  • Managing and Cancelling Subscriptions: Users may manage or cancel subscriptions at any time directly through Google Play:
    1. Open the Google Play Store app;
    2. Tap your profile icon at the top right;
    3. Select Payments & subscriptions > Subscriptions;
    4. Choose Wingene VIDA and tap Cancel subscription.
      • Note: Uninstalling the App from your device does not automatically cancel an ongoing subscription or trigger a refund.
  • Refund Policy: Refund requests are subject to Google Play’s official refund policies and must be processed directly through Google Play support.

5. License Grant and Intellectual Property

  • Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use Wingene VIDA on your compatible devices for personal, non-commercial purposes.
  • Ownership of the App: All intellectual property rights in the software, code, interface designs, logos, VIDA Method methodology, and system texts belong exclusively to Wingene / José Eugênio. You may not reverse-engineer, decompile, copy, distribute, or create derivative works from the App.
  • Ownership of User Content: You retain 100% ownership and copyright over the personal texts, reflections, notes, and records you write and store in the App.

6. Acceptable Use and Restrictions

When using Wingene VIDA, you agree not to:

  1. Use the App for any illegal, unauthorized, or abusive purpose;
  2. Bypass, disable, or attempt to circumvent security features, biometric authentication, or license validation systems;
  3. Attempt unauthorized access to related third-party APIs or infrastructure;
  4. Redistribute, clone, or publish modified binaries of the App outside official app stores.

7. Disclaimer of Warranties and Limitation of Liability

  • “As-Is” Provision: The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
  • Limitation of Liability: To the maximum extent permitted by applicable law, Wingene and its developers shall not be liable for: a) Direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the App; b) Accidental loss of data due to device malfunction, hardware failure, factory reset, or inadvertent user deletion; c) Inability to restore backups resulting from forgotten encryption passwords; d) Disruptions or outages in third-party services, including Google Drive, Google Play Services, or Google Gemini API; e) Personal, life, health, relationship, or financial decisions made by the User based on journal entries or AI suggestions.

8. Changes to These Terms

We reserve the right to revise or update these Terms of Service periodically to reflect product updates, regulatory requirements, or platform guidelines.

  • Significant modifications will be reflected with an updated “Last Updated” date at the top of this page.
  • Continued use of the App following the posting of updated Terms constitutes your acceptance of the revisions.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil (including the Brazilian General Data Protection Law - LGPD and the Civil Rights Framework for the Internet), alongside applicable Google Play Developer Distribution terms.
